Os planos para construir a primeira mina de carvão profunda do Reino Unido em mais de 30 anos foram anulados.
No Tribunal Superior, o juiz Holgate disse que as premissas ambientais que sustentam o desenvolvimento em Whitehaven, em Cumbria, eram “legalmente falhas”.
A proposta da West Cumbria Mining (WCM) recebeu sinal verde do governo conservador anterior em dezembro de 2022.
Victoria Marson, da Friends of the Earth, disse que os ativistas obtiveram “uma vitória massiva”. A WCM disse que “consideraria as implicações” do julgamento antes de fazer mais comentários.
Contestações legais à decisão de aprovar a mina foram apresentadas pela Friends of the Earth e pela South Lakes Action on Climate Change (SLACC).
Eles alegaram que a permissão para a mina não levou em consideração o impacto ambiental da queima do carvão extraído, mas sim se concentrou apenas na operação da instalação.
Os advogados da WCM disseram que houve “repetida caracterização errônea” dos planos e que o desenvolvimento teria um “efeito amplamente neutro na liberação global de gases de efeito estufa”.
Em seu julgamento, o Juiz Holgate disse: “A suposição de que a mina proposta não produziria um aumento líquido nas emissões de gases de efeito estufa, ou seria uma mina líquida zero, é legalmente falha.”
Duncan Pollard, administrador do SLACC, disse que a decisão foi um “grande alívio”, acrescentando: “Esperamos sinceramente que qualquer reexame da proposta da mina de carvão considere todas as questões relevantes e que essa ideia mal concebida seja permanentemente arquivada.
“O governo central e local precisam se concentrar em empregos seguros e sustentáveis para o oeste de Cumbria.”
Enquanto isso, Niall Toru, advogado sênior da Friends of the Earth, disse: “A mina nunca deveria ter recebido permissão em primeiro lugar.
“Os argumentos contrários são contundentes: teria enormes impactos climáticos, seu carvão não é necessário e prejudica a reputação internacional do Reino Unido em relação ao clima.”
O Sr. Toru afirmou que a decisão de sexta-feira pode ter ramificações internacionais.
Ele disse: “Há casos no exterior em que estão sendo feitas contestações contra projetos de combustíveis fósseis em bases muito semelhantes.”
Isso foi ecoado por Maggie Mason, do SLACC, que disse: “Este julgamento inovador pode avançar a eliminação global dos combustíveis fósseis. É muito grande.
“O Juiz Holgate destruiu forensemente suas reivindicações de minas de carvão neutras em termos de carbono e com emissões líquidas zero.”
Em uma audiência anterior em julho, o governo trabalhista recém-eleito decidiu não defender a decisão de seu antecessor de conceder permissão para o projeto, citando “um erro de lei”.
Mas a WCM lutou contra sua causa, argumentando que poderia construir uma mina líquida zero “única”.
O tribunal ouviu que a mina extrairia o que é conhecido como carvão metalúrgico, usado na fabricação de aço.
Em declarações escritas, Paul Brown KC, da Friends of the Earth, argumentou que “não há necessidade significativa de carvão” no Reino Unido, dadas as declarações da British Steel e da Tata sobre suas mudanças para fornos elétricos a arco.
O julgamento do Tribunal Superior afirmou que uma decisão recente decisão sobre o poço de petróleo Horse Hill em Surrey estava “no centro desses procedimentos”.
Em junho, a Suprema Corte decidiu que a concessão de permissão para o projeto foi ilegal porque a autoridade local deveria ter considerado as emissões da queima do petróleo, não apenas o impacto da construção do poço.
