Ele estava chegando em casa na noite de quinta-feira quando disse que foi atacado por um grupo de jovens. Ele estava com uma arma apontada para o rosto, houve uma briga e, antes que ele percebesse, os jovens o chutaram e ele foi nocauteado.
Foi o que aconteceu com um homem de 66 anos chamado Bernie, em um bairro próximo ao Patterson Park, na cidade de Baltimore. Seu olho esquerdo está inchado, preto e azul, e ele tem sete pontos perto da sobrancelha. Bernie não queria que seu sobrenome fosse divulgado publicamente, mas relembrou o terrível ataque.
“Na verdade, não ouvi nada. Eles estavam muito, muito quietos. Quase como se eles tivessem se aproximado de mim. Mas eu podia sentir a presença deles. Eles não disseram nada, mas quando os vi, estavam com máscaras de esqui”, lembrou Bernie.
Na minha cabeça, eu sabia o que estava por vir, então comecei a correr e eles começaram a me perseguir. Enquanto corria, gritava ‘socorro, socorro, estou sendo roubado’. Ele puxou a arma e enfiou-a na minha cara, e eu disse: ‘o que você quer?’ Ele disse: ‘Eu quero tudo’, disse Bernie.
Ele disse que havia cinco suspeitos que o atacaram. A polícia de Baltimore conseguiu rastrear e prender dois deles: Montaz Bailey, 18, e um homem não identificado de 15 anos. O suspeito de 15 anos foi levado ao Centro de Justiça Juvenil da cidade de Baltimore “para solicitar uma revisão da detenção”, segundo o BPD, mas foi liberado para um tutor. O jovem de 15 anos e Bailey já tiveram prisões anteriores, de acordo com o BPD.
Depois de analisar o vídeo e as evidências, o procurador do estado da cidade de Baltimore, Ivan Bates, autorizou que uma acusação de tentativa de homicídio em primeiro grau fosse movida contra Bailey.
“Acho que fui o alvo principal deles. Eles esperaram por uma excelente oportunidade para atacar. Eles são detidos e em poucas horas estão de volta às ruas”, disse Bernie. “Eles riem e acham que é uma piada. Para ser honesto com você, não posso culpá-los por rirem. Se eu estivesse no lugar deles, também estaria rindo disso. Se você pode cometer um crime e não ser responsabilizado, não há consequências, o que o impedirá?”
A polícia de Baltimore disse que uma arma foi recuperada dos dois adolescentes.
O comissário da polícia de Baltimore, Richard Worley, classificou o incidente como “verdadeiramente horrível” e disse que é preciso haver mais responsabilização para os jovens que infringem a lei.
“Estes incidentes prejudicam o trabalho do BPD e corroem a confiança que as nossas comunidades depositam em nós para mantê-las seguras”, disse o Comissário Worley através de comunicado.
O prefeito Brandon Scott também emitiu uma declaração, ecoando o sentimento do comissário Worley. O prefeito Scott disse que está frustrado com o aparente padrão de “necessidade repetida de prender os mesmos jovens” que ainda não foram responsabilizados por outras partes do sistema judiciário. O sistema mais amplo continua a falhar com os jovens, disse o prefeito Scott, e algo precisa mudar.
Mas o que será que mudará permanece uma questão sem resposta. Durante a sessão legislativa no início de 2024, os legisladores passaram a maior parte da sessão de 90 dias a debater leis de justiça juvenil. A polícia, os pais e os procuradores instaram os legisladores a fazer alterações nas leis de justiça juvenil, especificamente na forma como o estado lida com os infratores mais jovens.
A partir de 1º de novembro, os legisladores ampliaram as acusações que os jovens com idades entre 10 e 12 anos podem enfrentar. Haverá uma petição de Criança Necessitada de Supervisão, mandatada pelo tribunal, quando houver armas envolvidas nos crimes e quando os jovens forem acusados de roubar um carro pela primeira vez.
No entanto, a frustração persiste. Após o último ataque no bairro de Butchers Hill, o presidente do Senado, Bill Ferguson, e os outros delegados do Distrito 46 emitiram uma declaração levantando questões sobre por que o jovem de 15 anos foi entregue a um tutor.
“A situação lembra muito o que ocorreu no ano passado perto da Avenida Patterson Park, o que é parte do que levou a Assembleia Geral a aprovar reformas em nosso sistema de justiça juvenil no início deste ano”, dizia o comunicado.
O comunicado afirma que o grupo de legisladores – que inclui os delegados Luke Clippinger, Robbyn Lewis e Mark Edelson, além do senador Ferguson – está em contato com o secretário do Departamento de Serviços Juvenis, Vincent Schiraldi, para obter mais informações “para entender melhor como algo assim poderia acontecer de novo.” Os legisladores também disseram que entraram em contato com o procurador do estado da cidade de Baltimore, Ivan Bates, para “determinar os próximos passos apropriados”.
Não está claro quais medidas os legisladores tomarão durante a próxima sessão legislativa, mas Bernie disse que espera que eles façam alguma coisa.
“Não há responsabilização. Eles continuam deixando-os ir e deixando-os ir e é isso que você vai ter”, disse ele. “Vocês realmente começam a pensar em mudar algumas leis. E é melhor você fazer isso rápido antes que ele atinja sua casa.”
