O tribunal voltou a funcionar após o intervalo para almoço e as declarações de abertura devem começar em breve no histórico processo de difamação movido pela empresa de tecnologia eleitoral Dominion Voting Systems contra a Fox News.

Por que a Dominion está processando a Fox News? A Dominion processou a Fox News em 2021 devido à promoção repetida de falsas alegações sobre a empresa pela rede de direita, incluindo que suas máquinas de votação fraudaram a eleição de 2020 ao trocar milhões de cédulas de Donald Trump para Joe Biden. A maioria das 20 transmissões supostamente difamatórias mencionadas no processo ocorreu em novembro e dezembro de 2020.
A empresa alega que as pessoas na Fox News agiram com malícia real e “imprudentemente desconsideraram a verdade” quando espalharam essa desinformação sobre a Dominion. Para provar “malícia real”, a Dominion deve convencer um júri de que as pessoas na Fox News que foram responsáveis por essas 20 transmissões sabiam que as alegações da Dominion eram falsas ou desconsideraram imprudentemente as evidências de falsidade — mas as colocaram no ar mesmo assim.
De acordo com a teoria do caso da Dominion, a Fox promoveu essas teorias de conspiração eleitoral porque “as mentiras eram boas para os negócios da Fox”. O processo da Dominion se concentrou especificamente em programas apresentados por Lou Dobbs, Maria Bartiromo, Tucker Carlson, Sean Hannity e Jeanine Pirro. A Dominion disse que, como resultado da “campanha difamatória orquestrada” da Fox, ela sofreu “danos econômicos enormes e irreparáveis” e que seus funcionários foram submetidos a ameaças de morte e assédio.
Qual é a defesa da Fox? A Fox disse que não difamou ninguém e que o caso é um ataque sem mérito à liberdade de imprensa.
Um porta-voz da Fox disse que a rede “está orgulhosa de nossa cobertura das eleições de 2020” e que sua cobertura “está na mais alta tradição do jornalismo americano”. A empresa disse: “O processo da Dominion é uma cruzada política em busca de uma vantagem financeira, mas o custo real seriam os estimados direitos da Primeira Emenda”.
Fox também acusou a Dominion de gerar “barulho e confusão” em torno do caso, afirmando que “o cerne deste caso continua sendo a liberdade de imprensa e a liberdade de expressão, que são direitos fundamentais garantidos pela Constituição”, especificamente a Primeira Emenda.
A Fox tentou fazer com que o processo fosse arquivado. Mas, em um grande golpe para a rede de direita no mês passado, o juiz que supervisiona o caso permitiu que ele fosse a julgamento. Ele também proibiu a Fox de invocar algumas defesas importantes da Primeira Emenda, concluindo que elas não tinham mérito.
O que a Dominion está pedindo? A Dominion está buscando US$ 1,6 bilhão em danos. Eles dizem que as mentiras no ar da Fox destruíram sua reputação e estão fazendo com que os funcionários eleitorais cancelem seus contratos com a Dominion.
