O ex-tight end da NFL Kellen Winslow II, filho homônimo do lendário Charger e membro do Hall da Fama da NFL, está tentando reduzir sua pena de prisão de 14 anos em seu caso de estupro, argumentando que ele tem direito a uma sentença mais favorável devido às novas leis estaduais de condenação que beneficiam réus que sofreram traumas na infância.
A petição de Winslow, protocolada em um tribunal estadual de apelações, argumenta que seu padrasto abusou fisicamente dele e dois primos abusaram sexualmente dele quando ele era criança, causando danos psicológicos que o tornam elegível para uma sentença menor do que a que recebeu em março de 2021 de um juiz do Tribunal Superior de Vista. Winslow também argumentou que a suspeita de dano cerebral por jogar futebol — ele estimou em uma declaração juramentada que “provavelmente sofreu 100 concussões” — contribuiu para o trauma que deve qualificá-lo para a sentença reduzida.
“O requerente não pede para ser libertado da prisão neste momento, mas ele preenche os critérios para alívio … dado o trauma [brain damage] ele sofreu em sua vida de futebol, abuso físico e sexual ao qual foi submetido quando criança e o impacto de seu debilitante acidente de moto”, escreveu seu advogado em uma petição de habeas corpus protocolada na semana passada no 4º Tribunal Distrital de Apelações da Califórnia.
Winslow, 41, cresceu em San Diego e estudou nas escolas secundárias Patrick Henry e Scripps Ranch antes de estrelar no futebol americano pela Universidade de Miami. A sexta escolha geral do draft em 2004, ele jogou na NFL por 10 temporadas, até 2013. Ele teria ganhado mais de US$ 40 milhões ao longo de sua carreira na NFL.
Winslow foi condenado durante um julgamento de 2019 por estuprar uma mulher sem-teto de 58 anos que ele havia persuadido a se juntar a ele para um café. O júri também o condenou por acusações de má conduta sexual por se expor a uma vizinha de 57 anos em Encinitas e comportamento obsceno na frente de uma mulher de 77 anos em uma academia de Carlsbad.
O júri chegou a um impasse em várias acusações relacionadas a dois outros supostos estupros, um em 2003 envolvendo uma adolescente inconsciente — a garota tinha 17 anos, enquanto Winslow tinha 19 na época — e um em 2018 envolvendo um carona de 54 anos em Encinitas. No dia em que ele seria julgado novamente por esses incidentes, e com a possibilidade de uma sentença de prisão perpétua se condenado, ele se declarou culpado de acusações menores.
Com as condenações do júri e as confissões de culpa combinadas, ele inicialmente enfrentou uma sentença entre 12 e 18 anos, depois negociou uma pena de prisão de 14 anos. Na sentença, o juiz da Corte Superior Blaine Bowman descreveu Winslow como um “predador sexual … (que) caça vítimas vulneráveis e é muito descarado na maneira como executa seus crimes”. O juiz ordenou que Winslow se registrasse como um criminoso sexual para o resto da vida.
Durante a sentença, Bowman rejeitou os argumentos dos advogados de defesa de que o comportamento de Winslow poderia ter sido decorrente de traumatismo craniano repetido, observando que o incidente de 2003 aconteceu antes da carreira de Winslow na NFL.
Winslow apelou sem sucesso de sua sentença em várias ocasiões nos anos desde sua prisão. Em uma ocasião, ele buscou crédito de custódia pelo tempo em que estava em liberdade sob fiança, mas usando um monitor GPS. No ano passado, representando a si mesmo, Winslow entrou com uma petição buscando uma sentença reduzida pelos mesmos motivos de seu mais novo esforço.
Desta vez, Winslow é representado pelo especialista em apelações de San Diego, Patrick Ford.
“A maior parte de sua alegação tem a ver com os ferimentos repetitivos na cabeça e todo o trauma que ele sofreu por causa do futebol”, disse Ford na sexta-feira. Ford disse que é provável que Winslow tenha Encefalopatia Traumática Crônica, ou CTE, uma doença cerebral degenerativa comum entre pessoas que sofreram múltiplas concussões e lesões cerebrais, incluindo jogadores de futebol. A CTE não pode ser diagnosticada até que uma pessoa morra, mas a petição de Winslow argumenta que os exames médicos mostraram sinais consistentes com lesões cerebrais traumáticas e os exames de saúde mental revelaram sintomas que frequentemente acompanham a CTE.
“A visão do Legislativo é que pessoas que sofreram esse tipo de trauma seriam menos culpadas do que pessoas que fizeram a mesma coisa sem sofrer esse trauma”, disse Ford.
As duas leis estaduais em questão são o Projeto de Lei da Assembleia 124 e o Projeto de Lei do Senado 567. A legislação da Assembleia determina que um juiz de primeira instância, na ausência de certas circunstâncias agravantes, deve sentenciar um réu à menor das três sentenças potenciais se “A pessoa tiver sofrido trauma psicológico, físico ou de infância, incluindo, mas não se limitando a, abuso, negligência, exploração ou violência sexual”. A legislação do Senado exige que os juízes presumam que a sentença do meio de três sentenças potenciais é apropriada, na ausência de certos fatores agravantes.
“Acredito que as novas leis se aplicam ao meu caso por causa do dano cerebral causado por anos jogando futebol, dano cerebral adicional sofrido em um grave acidente de moto em 2005 e abuso físico e sexual que sofri quando criança”, escreveu Winslow em uma declaração juramentada que é uma prova de sua petição.
Não está claro se Winslow poderia realmente se qualificar para o alívio sob as leis, que entraram em vigor em 1º de janeiro de 2022. Winslow já havia sido condenado naquela época, embora sua petição afirme que as leis podem ser aplicadas retroativamente.
Ford disse que o tribunal de apelações analisará a petição de Winslow e decidirá se o gabinete do Procurador-Geral da Califórnia deve responder. Se o tribunal de apelações não rejeitar a petição, o próximo passo seria uma audiência probatória perante um juiz do Tribunal Superior de San Diego. Um painel de apelação de três juízes decidiria então sobre as questões legais do caso. Se os juízes de apelação finalmente decidissem que Winslow se qualificava para alívio sob as novas leis, um juiz de San Diego o sentenciaria novamente.
