Líderes de Chula Vista e National City aprovaram novas regras proibindo acampamentos de moradores de rua, aplicáveis independentemente da disponibilidade de vagas em abrigos.
Na terça-feira, o Chula Vista City Council aprovou por unanimidade uma portaria proibindo acampamentos em e perto de propriedades públicas. Autoridades da National City também aprovaram por 5-0 sua versão de proibição de acampamento. Elas se tornaram as últimas jurisdições no Condado de San Diego a adotar tais políticas.
A portaria de National City entra em vigor em 30 dias e a de Chula Vista ainda exige uma segunda votação.
As regras de Chula Vista proibiriam acampamentos a menos de 1.000 pés de escolas, parques da cidade, instalações de moradia de emergência e transição, pontos de bonde, centros de transporte e espaços abertos como os parques regionais Otay Valley e Sweetwater Valley. A política propôs uma distância de 500 pés desses locais, mas as autoridades concordaram que um buffer maior seria mais apropriado, especialmente em áreas frequentadas por crianças.
Quando nenhuma ameaça iminente estiver presente, a cidade ou a polícia teriam que emitir um aviso por escrito de 24 horas para desocupar um local antes da limpeza. Depois desse tempo, as pessoas poderão recuperar seus pertences que forem armazenados durante o processo. A portaria não especifica por quanto tempo a cidade manteria a propriedade.
“Precisamos agir”, disse o prefeito John McCann. Ele acrescentou que é “simplesmente desumano” “permitir que as pessoas fiquem nas ruas” e que a cidade tem a responsabilidade de manter os parques e outras áreas públicas livres para uso público.
A lei da National City proíbe acampar a menos de dois quarteirões de escolas, em qualquer curso d’água ou área natural adjacente a um curso d’água, pontos de parada de bonde e centros de trânsito.
A cidade daria um aviso de limpeza com 72 horas de antecedência e armazenaria quaisquer pertences pessoais coletados em uma instalação da cidade por 90 dias.
“Há uma necessidade de nossa cidade colocar essa portaria em prática”, disse a vereadora Luz Molina no início deste mês, quando as autoridades votaram pela primeira vez na política. “Não apenas por causa da ordem executiva do governador, mas também porque as cidades vizinhas em nossa região tomarão medidas semelhantes e isso deixará National City vulnerável se não colocarmos essa portaria em prática.”
Em junho, a Suprema Corte dos EUA decidiu que as autoridades podem desocupar acampamentos independentemente de haver leitos disponíveis em abrigos, uma decisão que levou o governador Gavin Newsom a emitir uma ordem executiva ordenando que as agências estaduais removessem as tendas de terras públicas e ameaçassem reter o financiamento de cidades e condados que não fizessem o mesmo.
As duas cidades do Condado de South consideraram por meses promulgar proibições de acampamento semelhantes a uma proibição parcial que San Diego aprovou há um ano. Mas decidiram esperar pela decisão da Suprema Corte em junho.
Quando o tribunal superior decidiu que as cidades poderiam esvaziar os acampamentos de tendas independentemente do espaço para abrigos, os líderes de Chula Vista e National City disseram que sentiam que suas cidades poderiam lidar com a falta de moradia de forma mais eficiente sem interferência legal.
A falta de moradia tem crescido consistentemente em todo o condado por mais de dois anos, incluindo em South Bay. O número de pessoas que ficam nas ruas de Chula Vista saltou 58 por cento no último ano para um total de 503 pessoas, de acordo com a contagem pontual de 2024. O mesmo relatório descobriu que a população de moradores de rua de National City aumentou de 159 para 174.
De acordo com autoridades do Condado de South, o aumento de pessoas nas ruas colocou uma pressão sobre os serviços da cidade porque eles responderam repetidamente a acidentes de trânsito e incêndios de vegetação que começaram em acampamentos. Até agora neste ano em National City, por exemplo, equipes de obras públicas gastaram cerca de US$ 400.000 limpando cerca de 60 toneladas de entulho ao limpar parques, vias verdes e canais de drenagem.
Chula Vista ainda não reabriu o Harborside Park, que os líderes da cidade fecharam há mais de dois anos depois que o espaço público se transformou em uma cidade de tendas e as preocupações aumentaram sobre as atividades ilícitas relatadas. Dezenas de moradores do parque montaram acampamento em uma avenida próxima. Quando foram expulsos daquela rua, muitos se mudaram para autoestradas. A cidade planeja reabrir o Harborside com medidas de segurança, como câmeras e uma estação de guardas florestais, no final deste outono.
“Esta portaria nos dará as ferramentas para ajudar a proteger e manter o parque reformado seguro porque, quando o abrirmos, precisaremos dessas ferramentas para garantir que ninguém durma no parque”, disse McCann, acrescentando que a proibição deve estar em vigor antes que a cidade possa reabrir Harborside.
Os defensores dos moradores de rua têm repetidamente chamado as proibições de acampamento de soluções paliativas.
“A proibição de pessoas sem moradia (é) cruel, mas, mais importante, não aborda a crise de pessoas sem moradia em Chula Vista”, disse Sebastian Martinez em uma declaração por escrito ao Conselho Municipal. “Tudo o que faz é exacerbar e dificultar que os provedores de serviços se conectem com os sem moradia em necessidade.”
Ambas as cidades dizem que oferecer abrigo, opções de moradia de longo prazo e serviços complementares continua sendo sua principal prioridade para lidar com a falta de moradia.
A San Diego Rescue Mission abriu recentemente o primeiro abrigo de emergência em National City com mais de 160 leitos. No entanto, a equipe da cidade disse que o local só pode acomodar 77 indivíduos devido aos níveis de pessoal e os leitos são disponibilizados para qualquer pessoa no condado.
A National City usará $405.900 que recebeu de um fundo estadual de liquidação de opioides para fornecer leitos para tratamento médico de transtorno de uso de substâncias. Ela divulgará uma solicitação de propostas nos próximos meses.
Nos próximos quatro anos, Chula Vista planeja ter mais de 150 unidades habitacionais de longo prazo que ofereçam serviços de apoio para pessoas em situação de rua crônica.
