Um cirurgião plástico e um enfermeiro de South Bay acusados pela morte de uma paciente submetida a uma cirurgia de aumento de mama em sua clínica em Bonita foram condenados na sexta-feira a penas de prisão estadual.
Carlos Chacon, 49, e Heather Lang Vass, 44, se declararam culpados por seus papéis na operação que levou à morte de Megan Espinoza, uma mãe de dois filhos de 36 anos e professora de jardim de infância local.
Os promotores disseram que a dupla atrasou o contato com os serviços de emergência por cerca de três horas depois que Espinoza sofreu uma parada cardíaca na clínica de Chacon, a Divino Plastic Surgery, em 19 de dezembro de 2018.
Chacon, que anteriormente enfrentou uma acusação de assassinato, declarou-se culpado de homicídio voluntário e três acusações de ajudar e encorajar uma pessoa a praticar medicina sem licença. Ele foi sentenciado na sexta-feira a uma pena estipulada de três anos de prisão, e sua declaração incluiu um acordo para uma suspensão vitalícia de sua licença médica na Califórnia.
Vass se declarou culpada de homicídio culposo e foi sentenciada a dois anos de prisão. Seu advogado, Domenic Lombardo, disse que ela entregou sua licença de enfermagem.
Os promotores disseram Chacon ordenou que sua equipe não ligasse para o 911 e os instruiu a mentir para o marido de Espinoza sobre sua condição. Chacon buscou assistência em vez disso telefonando para vários anestesiologistas, um dos quais disse a Chacon para ligar imediatamente para o 911. Outros disseram que teriam aconselhado que ele fizesse isso, mas Chacon mentiu sobre a gravidade da condição de Espinoza, de acordo com os promotores.
Ele também viu outros pacientes durante aquele período de três horas até que, eventualmente, os serviços de emergência foram chamados e Espinoza foi hospitalizada. Ela morreu mais de um mês depois de passar pela operação.
A família dela entrou com uma ação por homicídio culposo e negligência médica contra Chacon e o centro cirúrgico, que foi resolvida fora do tribunal.
Na audiência de sentença na sexta-feira, a juíza do Tribunal Superior de Chula Vista, Maryann D’Addezio, disse que a decisão de Chacon de não ligar para o 911 foi “inexplicável” e “injustificável”.
A juíza sugeriu que Chacon adiasse a ligação para o 911 porque seria descoberto que ele havia instruído Vass e outros membros da equipe médica a administrar anestesia em Espinoza e outros pacientes, apesar de eles não serem qualificados para isso. Ela também disse que uma ambulância chegando à clínica enquanto possíveis pacientes estavam no consultório o prejudicaria do ponto de vista comercial.
“Você pensou em você e somente em você”, disse D’Addezio.
A audiência de sexta-feira também incluiu discussões sobre um incidente que ocorreu cerca de seis meses antes do procedimento fatídico de Espinoza, no qual Vass medicou em excesso uma paciente que não conseguia acordar de sua sedação. Aquela mulher foi entregue a familiares e Chacon os instruiu a fazê-la “dormir”, disse o juiz, que caracterizou o incidente como uma demonstração de “sua falta de cuidado com seus pacientes”.
Chacon e Vass pediram desculpas à família e aos amigos de Espinoza presentes.
“Sinto muito, muito mesmo, pela imensa dor e sofrimento que minha falha em cumprir meu dever causou àqueles que a conhecem, conheceram e a amaram”, disse Chacon. “Não posso desfazer o que aconteceu e isso me assombra diariamente. Ela confiou em mim com seus cuidados e eu falhei com ela.”
Vass disse que também é mãe e pensa em como seus filhos seriam afetados se a perdessem.
“Não há palavras para expressar o quão profunda e verdadeiramente lamento minha participação em sua morte prematura e como isso vai me assombrar pelo resto dos meus dias por não ter pedido ajuda”, disse ela.
Os entes queridos de Espinoza disseram que seus filhos tinham 3 e 6 anos na época de sua morte, e agora têm 8 e 11 anos.
A mãe de Espinoza, Judith Gorcey, chamou sua filha de “uma mulher notável” que era amada pela família, amigos, colegas e seus alunos. Gorcey disse que, embora os filhos de Espinoza tenham amplo apoio familiar, “Todos nós juntos não podemos preencher o vazio que a morte de Megan trouxe para eles.”
O viúvo de Espinoza, Moises Espinoza, disse que foi “roubado de (poder) dizer adeus a ela” e “roubado do futuro”. Ele disse que seus filhos “nunca entenderão o amor que uma mãe tem”.
