A Utah State University teve mais de quatro anos para limpar seu departamento de atletismo — particularmente seu programa de futebol — que foi considerado pelo Departamento de Justiça como infestado por má conduta sexual. Isso não aconteceu, diz o DOJ.
Agora, a USU tem menos de 45 dias para mostrar que está progredindo.
No mês passado, o DOJ deu à universidade um aviso de “não conformidade substancial”. Na carta, a agência disse que a USU não estava aderindo a um acordo de 2020 para melhorar sua resposta a relatos de suposta agressão sexual. Na verdade, o DOJ escreveu que a USU “falhou em tomar medidas rápidas, equitativas e eficazes para remediar um ambiente hostil em andamento dentro de seu programa de futebol”.
Em seguida, estabeleceu um prazo de 45 dias a partir da emissão da carta em 21 de agosto para que a escola mostrasse que havia mudado a situação.
“Reconhecemos e compartilhamos as preocupações do DOJ”, disse a presidente da USU, Elizabeth Cantwell, na resposta oficial da universidade à carta de não conformidade. “Tomaremos todas as medidas necessárias para criar uma cultura duradoura de respeito dentro da USU e especialmente dentro do USU Football.”
O DOJ começou a investigar má conduta sexual e assédio dentro do programa de futebol, das fraternidades e irmandades da escola e seu programa de piano em 2017. Naquela época, várias alegações de má conduta sexual na escola foram relatadas na mídia, incluindo uma investigação do Salt Lake Tribune de 2016 sobre Torrey Green, um jogador do Aggies que foi acusado por quatro mulheres de estupro ou agressão sexual. Em 2019, Green foi condenado por agredir sexualmente seis mulheres enquanto estava na USU.
Em seu relatório mordaz de 2019, o DOJ questionou a falha da USU em responder a relatos de má conduta nas mãos de jogadores e funcionários. Ao longo de um período, disse, a universidade recebeu 15 relatos de suposta agressão sexual envolvendo jogadores de futebol americano dos Aggies, vários dos quais foram acusados várias vezes. Alegações contra dois membros da equipe do time de futebol americano também foram feitas durante esse período. No entanto, o relatório descobriu que “era comum a Universidade fechar os arquivos de incidentes envolvendo o time de futebol americano após apenas uma investigação mínima”.
O relatório do DOJ ecoou as conclusões de uma investigação interna conduzida pela USU em 2016.
Como resultado das duas investigações, a USU concordou em fevereiro de 2020 em traçar um plano para limpar o programa de futebol americano. Ela também se comprometeu a melhorar sua resposta às alegações e a se colocar em conformidade com os requisitos regulatórios do Título IX.
O DOJ diz que a USU não está cumprindo essas promessas.
“Quatro anos e meio após nossa notificação inicial à Universidade sobre nossas descobertas a respeito do programa de futebol, continua a haver evidências alarmantes de uma cultura e clima sexualmente hostis e generalizados dentro do programa de futebol e na (agora antiga) liderança sênior do Departamento de Atletismo”, dizia a carta, emitida em 21 de agosto. “Este ambiente foi permitido crescer e apodrecer devido a repetidas respostas ineficazes, injustas e inoportunas.”
A carta de não conformidade fez referência a dois incidentes específicos em sua rejeição aos esforços da USU.
Em um deles, ele descreveu como o ex-técnico Blake Anderson conduziu sua própria “missão de apuração de fatos” sobre as alegações por trás da prisão de um jogador de futebol americano em 2023 por violência doméstica, em vez de denunciá-la aos funcionários da escola. Anderson, que conduziu a investigação do vigilante com a supervisão do diretor atlético interino Jerry Bovee, se recusou a suspender o jogador enquanto investigava a suposta vítima e os companheiros de equipe do jogador sobre a altercação, disse a carta. A USU demitiu Anderson em julho por “violações significativas” de seu contrato e violação dos requisitos de relatórios do Título IX. Bovee e o diretor de desenvolvimento de jogadores Austin Albrecht, que foram destacados na carta do DOJ, também foram demitidos por não cumprirem as políticas da universidade em relação à denúncia de má conduta sexual e violência doméstica.
O segundo detalhou as experiências de uma especialista trazida para ministrar um treinamento sobre prevenção de má conduta sexual para uma parte do time de futebol americano da USU em outubro. A especialista relatou, de acordo com a carta do DOJ, que durante todo o treinamento, “jogadores de futebol americano zombaram coletivamente, riram, riram e interromperam repetidamente o treinamento com comentários ofensivos baseados em sexo”. Ela e o DOJ interpretaram suas ações e a falha da equipe de futebol americano em interceder como “mais uma indicação de cultura e clima tóxicos e exemplo de desrespeito dos membros do time de futebol americano pelos esforços da Universidade para cumprir o Título IX e o [2020 compliance] Acordo.”
O DOJ reconheceu alguns passos que a USU tomou na direção certa. Em particular, destacou a demissão de Anderson, Bovee, Albrecht e Amy Crosbie, a diretora atlética associada executiva para assuntos internos por relatar violações. A agência também observou que a escola contratou alguém para conduzir treinamentos sobre má conduta sexual com atletas estudantes e funcionários.
Além disso, a escola disse que adicionou pessoal ao seu Office of Equity para lidar melhor com os relatórios e está trabalhando “para criar uma cultura de relatórios”. Ela também identificou seis outras medidas que poderia tomar mais imediatamente. Entre elas estavam melhorar a comunicação entre o Office of Equity e a equipe atlética, enfatizando aos jogadores de futebol que a má conduta sexual não será tolerada e atualizando os materiais de treinamento para impedir que os funcionários conduzam suas próprias investigações sobre má conduta sexual.
