A plataforma de mídia Infowars do teórico da conspiração Alex Jones e seus ativos serão vendidos aos poucos em leilões neste outono para ajudar a pagar mais de US$ 1 bilhão que ele deve a parentes das vítimas do tiroteio na Escola Elementar Sandy Hook, sob uma ordem que deve ser aprovada por um juiz federal.
O Juiz de Falências dos EUA Christopher Lopez em Houston disse durante uma audiência judicial na terça-feira que ele aprovará os leilões que começam em novembro. Mas ele disse que primeiro precisa mudar uma ordem anterior para deixar claro que o administrador que supervisiona o caso de falência pessoal de Jones controla todos os ativos da empresa-mãe da Infowars, a Free Speech Systems, que é 100% de propriedade de Jones.
Apesar da perda pendente de sua empresa, Jones promete continuar seus talk shows por outros meios, possivelmente incluindo um novo site e suas contas pessoais de mídia social. Ele também sugeriu que os ativos da Infowars poderiam ser comprados por seus apoiadores, permitindo que ele continuasse apresentando seu programa como um funcionário sob a marca Infowars em sua cidade natal, Austin, Texas.
“É muito claro e direto que os ativos da Free Speech Systems, o site, o equipamento, o carrinho de compras, tudo isso, podem ser vendidos”, disse Jones em um programa recente. “E eles sabem muito bem que há um bando de compradores patriotas, e então a operação pode facilitar.”
Jones e sua empresa entraram com pedido de proteção contra falência em 2022 — o mesmo ano em que as famílias de Sandy Hook ganharam quase US$ 1,5 bilhão em processos de difamação e sofrimento emocional contra Jones por ele ter chamado repetidamente o tiroteio escolar de 2012 de uma farsa encenada por “atores de crise” para conseguir que mais legislação de controle de armas fosse aprovada. Vinte alunos da primeira série e seis educadores foram mortos no tiroteio em Newtown, Connecticut.
Durante dois julgamentos civis no Texas e Connecticut, pais e filhos de muitas das vítimas testemunharam que ficaram traumatizados pelas conspirações falsas de Jones e pelas ações de seus seguidores. Eles disseram que foram assediados e ameaçados pelos fiéis de Jones, alguns dos quais confrontaram as famílias enlutadas pessoalmente, dizendo que o tiroteio nunca aconteceu e que seus filhos nunca existiram. Um dos pais disse que alguém ameaçou desenterrar o túmulo de seu filho morto.
Jones está apelando dos vereditos do júri civil, citando direitos de liberdade de expressão e questionando se as famílias provaram alguma conexão entre seus comentários e as pessoas que assediaram e ameaçaram os parentes. Desde então, ele reconheceu que o tiroteio aconteceu.
Em junho, Lopez converteu o caso de reorganização de falência pessoal de Jones em uma liquidação, o que significa que muitos de seus ativos serão vendidos para pagar credores, exceto sua casa principal e outras propriedades isentas. No mesmo dia, Lopez também rejeitou o caso de falência da Free Speech Systems depois que Jones e as famílias não conseguiram chegar a um acordo sobre um plano final.
A ordem de liquidação que Lopez pretende aprovar colocaria a propriedade intelectual da Infowars em leilão em 13 de novembro, incluindo suas marcas registradas, material protegido por direitos autorais, contas de mídia social e sites. Os sites pessoais de mídia social de Jones, incluindo sua conta na plataforma social X, que tem 2,8 milhões de seguidores, não seriam incluídos.
No entanto, o administrador que supervisiona o caso de falência de Jones, Christopher Murray, disse na terça-feira que em breve poderá buscar permissão judicial para também liquidar as contas pessoais de mídia social de Jones e sua outra propriedade intelectual — às quais os advogados de Jones se opuseram. Essa questão pode se transformar em outra briga judicial no caso de falência. Murray também deve vender muitos dos bens pessoais de Jones.
As famílias de Sandy Hook que ganharam o processo de Connecticut querem que Jones perca suas contas pessoais de mídia social. Seus advogados argumentam ainda que as famílias devem receber uma parte de todos os ganhos futuros de Jones para ajudar a pagar sua dívida de mais de US$ 1 bilhão.
Christopher Mattei, advogado das famílias de Sandy Hook no processo de Connecticut, disse que a assinatura da ordem de leilão pelo juiz será “um passo significativo” nos esforços da família para fazer Jones pagar por suas mentiras falsas.
“Alex Jones não mais possuirá ou controlará a empresa que ele construiu”, disse Mattei em uma declaração na terça-feira. “Isso aproxima as famílias de seu objetivo de responsabilizá-lo pelos danos que ele causou.”
O restante dos ativos da Infowars, incluindo computadores, câmeras de vídeo e outros equipamentos de estúdio, seriam vendidos em um leilão diferente em 10 de dezembro.
Jones ganhou milhões de dólares ao longo dos anos vendendo suplementos alimentares, vestuário, equipamentos de sobrevivência, livros e outros itens que ele promove em seus programas, que vão ao ar na internet e em dezenas de estações de rádio. Não está claro quanto dinheiro seria arrecadado com a venda do Infowars e dos ativos de Jones, e quanto dinheiro as famílias de Sandy Hook receberiam.
Jones tem cerca de US$ 9 milhões em ativos pessoais, de acordo com os autos do tribunal. A Free Speech Systems tem cerca de US$ 6 milhões em dinheiro em caixa e cerca de US$ 1,2 milhão em estoque, de acordo com depoimentos anteriores do tribunal.
Espera-se que advogados, especialistas financeiros e outros que trabalharam nos casos de falência de Jones — que acumularam milhões de dólares em honorários e despesas — sejam pagos primeiro.
Uma disputa legal restante no caso de falência é se a Free Speech Systems deve mais de US$ 50 milhões a outra empresa de propriedade de Jones, a PQPR Holdings Limited. A Free Speech Systems compra suplementos alimentares da PQPR para vender no site Infowars. A PQPR disse que não foi paga por muitos dos suplementos e entrou com ações de gravames. Os advogados de Sandy Hook alegam que a dívida é falsa.
Se a dívida for considerada válida, isso poderá reduzir qualquer quantia que as famílias de Sandy Hook receberão das liquidações.
