O governo espera que a proibição de despejo de inquilinos na Inglaterra sem motivo esteja em vigor até o próximo verão, disse o Ministro da Habitação, Matthew Pennycook.
Os planos fazem parte de um Projeto de Lei dos Direitos dos Inquilinos, que será apresentado ao Parlamento posteriormente.
A proibição de despejos “sem culpa” foi proposta inicialmente pelos conservadores, mas foi adiada em meio a preocupações sobre o impacto sobre os proprietários por parte de alguns parlamentares conservadores, e o tempo para aprovar a lei acabou antes da convocação das eleições de julho.
O projeto de lei também proibiria “guerras de lances” e impediria que proprietários bloqueassem inquilinos com benefícios ou com filhos.
Grupos de inquilinos acolheram o projeto de lei, que, segundo eles, tinha proteções mais fortes para os inquilinos do que a versão anterior.
No entanto, eles disseram que mais trabalho era necessário para combater aumentos injustos de aluguel.
Enquanto isso, os proprietários disseram que era “vital” que o setor tivesse tempo suficiente para se preparar adequadamente para as mudanças.
Questionado sobre a rapidez com que as mudanças seriam introduzidas, Pennycook disse à BBC Breakfast: “Esperamos [the bill] progredirá muito rapidamente na Câmara dos Comuns e teremos esse novo sistema de locação em vigor no primeiro semestre ou por volta do verão do ano que vem.”
Os planos precisam ser aprovados pelos parlamentares e pares, que podem propor novas mudanças, antes de se tornarem lei.
De acordo com as propostas, Pennycook disse que os proprietários ainda teriam “motivos sólidos” para retomar a posse de suas propriedades, se necessário; por exemplo, se quisessem vender ou se mudar para a casa, ou se um inquilino estivesse causando comportamento antissocial ou com aluguel atrasado.
‘Fiquei no limbo’
Anne, de Northampton, disse que ficou em “um estado de limbo” depois que seu senhorio lhe entregou um aviso de despejo sem culpa.
“[My landlord] queria morar lá de novo, o que é justo. Mas era minha casa”, ela disse à BBC Radio 5 ao vivo.
“Fiquei sem condições de pagar aluguel particular porque nos últimos quatro anos os aluguéis aumentaram drasticamente.”
Anne estava enfrentando a falta de moradia, o que ela descreveu como uma “experiência horrível”, até que o conselho local encontrou uma acomodação temporária para ela no último minuto.
Agora ela está esperando um lar permanente.
“É justo que [my landlord] deveria poder ter sua casa de volta. Mas onde isso me deixa?” ela disse.
“O maior problema é a falta de opções disponíveis para pessoas como eu.”
O que o projeto de lei propõe
Ben Twomey, presidente-executivo do grupo de campanha Generation Rent, disse que proibir despejos sem culpa era “dolorosamente tarde” e “daria aos inquilinos mais confiança para desafiar a degradação e o tratamento inadequado por parte de proprietários e agentes de locação”.
Ele acrescentou: “O governo também prometeu fornecer aos inquilinos maiores proteções contra aumentos injustificados de aluguel, mas é necessário mais trabalho para tornar isso uma realidade.”
O governo disse que o projeto de lei proibiria que aumentos de aluguel durante a locação fossem incluídos nos contratos e que os proprietários só poderiam aumentar o aluguel uma vez por ano para o preço de mercado.
No entanto, o Sr. Twomey disse que os inquilinos continuariam vulneráveis aos aumentos de aluguel.
Tom Darling, diretor da Renters’ Reform Coalition, disse que o novo projeto de lei era “uma legislação mais forte do que a tentativa anterior”, incluindo períodos de notificação mais longos para inquilinos que são despejados e um período mais longo no início de uma locação em que as pessoas são protegidas contra despejo.
No entanto, ele disse que “ainda há áreas para melhorias”.
“Este projeto de lei tem pouco a dizer sobre um dos maiores problemas enfrentados pelos locatários: o custo”, disse ele.
“‘Despejos econômicos’ por meio de aumentos de aluguel são um fator importante na falta de moradia e na insegurança.”
Outras medidas do projeto de lei incluem:
- permitindo aos inquilinos o direito de ter um animal de estimação
- uma proibição de guerras de lances de aluguel, com proprietários e agentes de locação legalmente obrigados a publicar um aluguel pedido por sua propriedade e impedidos de encorajar ou aceitar lances acima desse preço
- estendendo Lei de Awaab para o setor de arrendamento privado, obrigando os proprietários a resolver problemas como humidade e bolor dentro de um prazo especificado
- acabar com as proibições gerais para inquilinos com filhos ou que recebem benefícios
Ben Beadle, presidente-executivo da National Residential Landlords Association, disse que era essencial que o projeto de lei fosse “justo tanto para inquilinos quanto para proprietários”.
De acordo com as propostas, ele disse que os tribunais precisariam ouvir reivindicações de posse nas quais os proprietários tivessem um motivo legítimo para reaver suas propriedades.
O Sr. Beadle destacou os alertas dos parlamentares de que “sem reformas para garantir que os tribunais processem os casos muito mais rapidamente, eles correm o risco de ficar sobrecarregados”.
Um porta-voz do Partido Conservador disse que quaisquer novas regulamentações devem ser “necessárias e proporcionais”.
Eles acrescentaram que “leis mal elaboradas reduzirão a oferta, forçando o aumento dos aluguéis e reduzindo as opções para os locatários”.
