Mais de 1.700 prisioneiros foram libertados antecipadamente na Inglaterra e no País de Gales como parte de um esquema do governo para aliviar a superlotação nas prisões.
Um prisioneiro libertado disse que as condições em sua prisão eram “repugnantes”, com “água saindo escura das torneiras” e “ratos correndo pelos corredores”.
Nem todas as vítimas de crimes foram informadas sobre a data de libertação antecipada de seus agressores, disse o comissário de vítimas da Inglaterra e do País de Gales, alertando que algumas vítimas podem não ter tido a oportunidade de buscar “medidas de proteção”.
O governo disse que infratores presos por crimes violentos com sentenças de pelo menos quatro anos, criminosos sexuais e agressores domésticos não eram elegíveis para libertação antecipada.
A Baronesa Newlove, comissária de vítimas da Inglaterra e do País de Gales, alertou que nem todas as vítimas de crimes foram informadas sobre a data de libertação antecipada de seus agressores e tiveram a oportunidade de buscar “medidas de proteção”.
Ela disse que, desde o início do esquema, buscou garantias de que todas as “vítimas afetadas” seriam informadas sobre quaisquer datas de liberação antecipada, dando-lhes a oportunidade de solicitar medidas de proteção.
O sindicato de liberdade condicional de Napo disse que agressores domésticos e criminosos sexuais estavam entre os libertados.
Descreveu o esquema de libertação antecipada de prisioneiros como uma “bomba-relógio que poderia colocar a segurança pública em risco”.
Em um comunicado, o sindicato de liberdade condicional disse temer que o esquema estivesse “transferindo o problema de um lugar para outro sem avaliar adequadamente os riscos”.
Em resposta, o Ministério da Justiça (MoJ) destacou que a elegibilidade para o esquema era baseada na infração, não no infrator. Alguns infratores podem ter sido liberados mais cedo de uma sentença por uma infração menor quando já haviam cumprido uma sentença por uma infração sexual ou violenta, acrescentou.
Nicole Jacobs, comissária de violência doméstica da Inglaterra e do País de Gales, pediu uma isenção geral para todos os perpetradores de violência doméstica conhecidos.
“Não há justiça em permitir que perpetradores de abuso doméstico sejam libertados mais cedo”, disse a Sra. Jacobs, acrescentando: “Pode não ser possível que todas as vítimas sejam notificadas sobre a libertação de seus agressores e temo que elas possam ser pegas de surpresa”.
Não há uma única infração para abuso doméstico. Certos crimes como controle coercitivo, assédio e perseguição foram excluídos do esquema, mas não outros, incluindo ameaças de morte e danos corporais reais. Prisioneiros condenados por essas infrações ainda podem se qualificar para libertação antecipada.
A vítima de agressão Elizabeth Hudson disse à BBC que se sentiu “doente” depois de ser informada de que seu agressor poderia ser libertado sob o esquema.
Martin Underwood, 49, foi preso por seis anos e três meses por atacar a Sra. Hudson em sua casa em Barnsley em abril de 2021, antes de agredir uma segunda vítima enquanto estava em liberdade sob fiança policial.
A Sra. Hudson o descreveu como “um homem perigoso, violento e perigoso que me atacou por muitos anos, não apenas naquela manhã”.
Ela acrescentou: “Há um padrão de comportamento, não há nenhuma dúvida sobre se é ou não abuso doméstico.”
Underwood pode ser solto em junho de 2025 sob o esquema de emergência. O MoJ disse que ele cumpriu sua pena pelos crimes de abuso doméstico de estrangulamento e ameaças de morte, e seria solto mais cedo de uma sentença adicional por agressão.
De acordo com o plano de libertação, anunciado em julho, infratores em prisões na Inglaterra e no País de Gales cumprindo penas de menos de cinco anos serão libertados sob licença na comunidade após cumprirem 40% de suas penas, em vez de 50%.
A liberdade condicional significa que os infratores devem cumprir restrições pelo resto da pena, incluindo toque de recolher e marcação, e serão supervisionados por agentes de condicional.
O inspetor-chefe das prisões Charlie Taylor disse que o governo “não tinha escolha a não ser fazer algo” sobre a superlotação. Mas ele alertou que era “inevitável que alguns desses prisioneiros fossem chamados de volta à custódia”.
O secretário-geral do Napo, Ian Lawrence, disse que as libertações antecipadas estavam “disfarçando as coisas”, acrescentando: “É provável que vejamos muitas pessoas sendo chamadas de volta à prisão em pouco tempo”.
Entre os libertados na terça-feira estava John Price, um homem de 34 anos que disse à BBC que havia sido libertado quatro dias antes de uma sentença de seis meses e meio por danos corporais na prisão de Nottingham.
Price disse que uma acomodação foi providenciada para ele e que ele esperava voltar a trabalhar.
“Eu teria ficado lá feliz pelo resto do tempo se fosse preciso”, disse ele, mas disse que as condições na prisão eram “terríveis… há muita violência”.
Ryan Surplice, de Birmingham, foi libertado da HMP Manchester na terça-feira após ser preso por três anos por roubo.
“As alas lá dentro estão condenadas. É nojento naquela prisão, há água saindo preta das torneiras, ratos correndo pelas alas”, disse Surplice à BBC.
Outro infrator, liberado da prisão HMP Wormwood Scrubs após cumprir 19 meses de uma sentença de três anos e meio por crimes relacionados a drogas, disse que o esquema de liberação antecipada foi bom para sua família, mas acrescentou: “Não sei se concordo com a liberação antecipada de todos, especialmente para crimes mais sérios”.
Os números do MoJ mostraram que a população carcerária masculina e feminina combinada atingiu um recorde de 88.521 na sexta-feira, com capacidade operacional de 89.619.
A secretária de Justiça, Shabana Mahmood, disse que cerca de 5.500 infratores serão soltos em setembro e outubro, deixando a prisão algumas semanas ou meses antes, para cumprir o restante de suas penas sob condições estritas de licença.
Mahmood disse aos parlamentares na terça-feira que os presos que ficarem desabrigados após a libertação antecipada poderão ser colocados temporariamente em hotéis econômicos financiados pelos contribuintes se não houver espaço suficiente nas acomodações normalmente usadas para os infratores.
O esquema de libertação antecipada foi desencadeada pelo governo trabalhista que assumiu o poder dias após as eleições gerais, mas as autoridades já estavam a elaborá-la quando os conservadores estavam no poder.
O secretário de justiça disse que o esquema evitou “um colapso total da lei e da ordem”.
Falando aos parlamentares, Mahmood disse que o governo está “comprometido em publicar uma estratégia de capacidade de 10 anos”, ao mesmo tempo em que “cobre o déficit de 14.000 vagas” do governo anterior.
Um porta-voz do Ministério da Justiça disse que o governo herdou “um sistema de justiça à beira do colapso”.
“Fomos forçados a tomar medidas difíceis, mas necessárias, com salvaguardas em vigor, para que possamos continuar prendendo infratores e proteger o público.”
Os libertados sob o esquema estarão sujeitos a “supervisão total da liberdade condicional”, que incluirá “restrições severas” em muitos casos, disse o MoJ.
