Um professor que carregou um cartaz em um protesto pró-Palestina retratando Rishi Sunak e Suella Braverman como cocos foi considerado inocente de uma infração à ordem pública com agravante racial.
Marieha Hussain, 37, de High Wycombe, Buckinghamshire, negou a acusação no Tribunal de Magistrados de Westminster na sexta-feira.
Ela carregava uma foto mostrando os rostos do então primeiro-ministro e do secretário do Interior sobrepostos em cocos sob uma palmeira em novembro de 2023.
Sua defesa disse que o cartaz não era racista, mas satírico e humorístico.
O promotor Jonathan Bryan argumentou que coco era uma injúria racial bem conhecida, sugerindo que alguém era moreno por fora, mas branco por dentro.
O Sr. Bryan alegou que a Sra. Hussain havia cruzado a linha entre a expressão política legítima e o insulto racial.
Ele disse: “Coconut é uma calúnia racial bem conhecida que tem um significado muito claro.
“Você pode ser marrom por fora, mas é branco por dentro. Em outras palavras, você é um traidor da raça – você é menos marrom ou preto do que deveria ser.”
Uma imagem no outro lado do cartaz retratava a ex-secretária do Interior como “Cruella Braverman”, disse a Sra. Hussain em um comunicado.
A defesa da Sra. Hussain descreveu a decisão de levar o caso ao tribunal como um ataque perturbador ao direito à liberdade de expressão e ao protesto pacífico.
Em uma declaração lida ao tribunal, a Sra. Hussain disse: “Acho surpreendente que isso possa ser concebido como uma mensagem de ódio.”
Rajiv Menon KC, em defesa, disse: “Que Marieha Hussain, de todas as pessoas, esteja sendo processada por um crime racialmente agravado, enquanto pessoas como Suella Braverman, Nigel Farage, Stephen Yaxley-Lennon — também conhecido como Tommy Robinson — e Frank Hester aparentemente estão livres para fazer declarações inflamatórias e divisivas… é, temo, incompreensível para muitas pessoas.”
O Sr. Menon disse A Sra. Hussain era uma mulher de “caráter impecável”, acrescentando: “Seria uma tragédia — uso essa palavra deliberadamente — que ela fosse condenada por um crime racialmente agravado quando ela obviamente não tem um pingo de racismo no corpo.”
Ele disse ao tribunal que o cartaz era “uma tentativa ilustrada” de “crítica política” ao Sr. Sunak e à Sra. Braverman.
Após um julgamento de dois dias, o juiz decidiu que o cartaz era “parte do gênero de sátira política”.
A juíza distrital Vanessa Lloyd disse: “Dessa forma, a promotoria não provou, dentro do padrão criminal, que houve abuso.
“A acusação também não provou, segundo os padrões criminais, que você sabia que seu cartaz poderia ser abusivo.”
